1. Eligibility

To participate in the Dreamy Desire Affiliate Program you must:

• be at least 18 years of age;
• be resident in Canada;
• operate a website, blog, social media account, newsletter or other promotional channel that complies with these terms;
• maintain an audience that is predominantly of legal age to purchase adult products in their jurisdiction;
• provide accurate and complete information in your application and keep it current.

We may decline any application at our discretion. Approval is not guaranteed and is not based solely on traffic volume.

2. Application & Approval

Applications are reviewed manually. We aim to respond within 1–2 business days, though review times may vary. If approved, you will receive access to your unique affiliate link and promotional materials.

Approval covers the specific channels listed in your application. If you wish to promote through additional websites or social accounts, notify us in advance at support@dreamydesire.com.

3. Commission Rate

Approved affiliates earn 25% commission on the net product value of qualifying orders referred through their affiliate link.

Net product value excludes shipping charges, applicable taxes (GST, HST, PST, QST), gift wrapping, and any discount, credit or gift card value applied to the order.

We may change the commission rate at any time. Rate changes apply prospectively and will be communicated by email before taking effect.

4. Tracking & Attribution

Referrals are tracked using a 30-day cookie. If a customer clicks your affiliate link and completes a purchase within 30 days, the order is attributed to you, provided no subsequent affiliate link has overwritten the attribution.

Attribution follows a last-click model. If a customer clicks multiple affiliate links before purchasing, commission is credited to the most recent affiliate.

Tracking depends on the customer's browser accepting cookies. We cannot credit referrals where cookies have been blocked, cleared, or where the customer switches devices between click and purchase. We are not liable for tracking failures outside our reasonable control.

5. Qualifying Sales

A sale qualifies for commission when the order is placed through a valid affiliate link, paid in full, and shipped.

The following do not qualify:

• orders that are cancelled, refunded, charged back or otherwise reversed;
• orders flagged as fraudulent;
• orders placed by the affiliate, or by members of the affiliate's household, using their own link (self-referral);
• orders where the affiliate link was applied after the customer had already reached checkout;
• gift card purchases.

For hygiene reasons, our products are not returnable after use. Refunds are issued only where an item arrives damaged, defective or incorrect, as set out in our Refund Policy. Where such a refund or a chargeback occurs after commission has been paid, the amount will be deducted from your next payout, or invoiced if no future payout is pending.

6. Payment Terms

• Schedule: commissions are calculated at the end of each calendar month and paid within 30 days of that month's close.
• Minimum payout: CAD $50. Balances below this threshold roll over to the following month.
• Method: PayPal. You are responsible for providing and maintaining accurate payment details.
• Currency: all commissions are calculated and paid in Canadian dollars.

We are not responsible for payments that fail or are misdirected due to incorrect payment details supplied by you. Unclaimed balances on accounts inactive for 12 months may be forfeited.

7. Promotional Conduct

You agree to promote Dreamy Desire honestly and in compliance with applicable law, including Canada's Competition Act and Anti-Spam Legislation (CASL), and the advertising and disclosure rules of any platform you use.

You must clearly disclose your affiliate relationship wherever you post affiliate links, in a manner a reasonable reader would notice and understand.

You may not make claims about our products, pricing, shipping times, health benefits or medical efficacy that are inaccurate, unsubstantiated or not published by us.

8. Prohibited Promotion Methods

You may not:

• send unsolicited email, SMS or messages of any kind;
• use adware, spyware, browser extensions, toolbars, pop-unders or cookie-stuffing techniques;
• post affiliate links on coupon, deal or cashback sites without written approval;
• create content that impersonates Dreamy Desire or implies you are an employee, agent or official representative;
• register domain names, social handles or app names containing "Dreamy Desire" or confusingly similar variations;
• place links on sites containing illegal content, hate speech, harassment, or content that sexualises minors;
• artificially inflate clicks or referrals by any automated or deceptive means.

9. Paid Search & Brand Bidding

Bidding on brand terms in paid search is strictly prohibited. This applies to Google Ads, Microsoft Advertising (Bing), Yahoo, and any other paid search platform.

You may not bid on, or purchase advertising against:

• "Dreamy Desire", "DreamyDesire", "dreamydesire.com", or any misspelling or close variation;
• the brand names of products we carry, including but not limited to Fleshlight, Lelo, We-Vibe, Womanizer, Satisfyer, Fun Factory, and any other manufacturer brand sold on our store;
• any combination of the above with generic modifiers (for example "Dreamy Desire coupon" or "Fleshlight Canada").

You may not use our brand terms in ad copy, display URLs or as direct display URLs pointing to your affiliate link. Direct linking from a paid ad to dreamydesire.com is not permitted.

Violation of this section results in immediate termination and forfeiture of all unpaid commission. Certain of these restrictions arise from trademark agreements with our suppliers and are not negotiable.

10. Use of Brand Assets

We grant you a limited, non-exclusive, revocable licence to use the Dreamy Desire name, logo, banners and product images solely to promote our products during the term of your participation.

You may not modify our logo, alter product images beyond cropping and resizing, or use our assets in a way that suggests partnership, sponsorship or endorsement beyond the affiliate relationship. This licence ends immediately upon termination.

11. Content Standards & Age Restrictions

Our products are intended for adults. You must not promote Dreamy Desire on any platform, channel or content that is directed at minors, that is likely to be accessed primarily by minors, or that features individuals under 18 in any context connected to our products.

Where a platform provides age-gating, sensitive content controls or similar tools, you are responsible for applying them appropriately.

We reserve the right to terminate participation immediately, without notice and without payment of outstanding commission, for any breach of this section.

12. Relationship of the Parties

You are an independent contractor. Nothing in these terms creates an employment, partnership, joint venture or agency relationship. You have no authority to make commitments on our behalf, and you are responsible for your own expenses, equipment and business operations.

13. Taxes

You are solely responsible for reporting and remitting all taxes on commission income, including income tax and any GST/HST obligations where applicable.

Where required by the Canada Revenue Agency, we may issue tax slips and may request a Social Insurance Number or Business Number before releasing payment.

14. Confidentiality & Data

Commission rates, conversion data, promotional offers not yet public, and any other non-public information shared with you must be kept confidential.

You will not receive customer personal information. Any data provided through affiliate reporting is aggregated and must not be used for any purpose other than evaluating your own performance. Your personal information is handled in accordance with our Privacy Policy.

15. Termination

Either party may terminate participation at any time, for any reason, with written notice. Termination is effective immediately upon notice.

On termination you must remove all affiliate links and brand assets from your channels within 10 business days. Commission on qualifying orders placed before termination will be paid on the normal schedule, except where termination results from a breach of these terms, in which case outstanding commission may be forfeited.

16. Changes to These Terms

We may amend these terms at any time. Material changes will be communicated by email to the address on your affiliate account. Your continued participation after the effective date constitutes acceptance. If you do not agree to a change, your remedy is to terminate your participation.

17. Limitation of Liability

The affiliate program is provided on an "as is" basis. To the fullest extent permitted by law, Dreamy Desire – A Vamoson INC is not liable for indirect, incidental, special or consequential damages, or for lost profits or anticipated commission, arising from your participation.

Our total aggregate liability to you is limited to the total commission paid to you in the six months preceding the event giving rise to the claim.

We do not guarantee any level of traffic, conversion, earnings or program continuity, and may suspend or discontinue the program at any time. These terms supplement our Terms of Service; where the two conflict in relation to the affiliate program, these terms prevail.

18. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties submit to the exclusive jurisdiction of the courts of Ontario.
